1. General Provisions
1.1. These Boat Rental Regulations specify the detailed rules and conditions for renting boats to individuals without a motorboat license and to those with a motorboat license, as well as for cruises with our skippers at the helm, conducted through the “Rejsowisko” marina (“Marina”), managed by Adar sp. z o.o. headquartered in Warsaw, address: ul. Międzyborska 48 lok. użytkowy 3, 04-041 Warsaw, registered in the Register of Entrepreneurs of the National Court Register, XIII Commercial Division of the National Court Register under number KRS: 0000773619, NIP: 113-299-40-09, REGON: 382651715, with a share capital of 5,000.00 PLN (“Company”).
1.2. The legal titles to the boats used for rental (“Boats”) belong to Adar sp. z o.o.
1.3. The boats comply with legal regulations regarding inland navigation and are equipped according to the law. The boats, to the extent required by law, are operated by Adar’s employees with the necessary qualifications.
1.4. The boats have valid insurance policies in the scope of OC, AC, and NNW, which exempt the renter from liability in case of a collision, provided that the equipment is used properly and according to its intended purpose.
2. Reservations and Rentals
2.1. To rent a boat, a reservation must be made:
• through the reservation system on the Company’s website: https://rejsowisko.pl;
• via email: info@rejsowisko.pl;
• by phone: +48 576 75 76 79;
• in person, at the location of the Rejsowisko Marina, situated at Bulwar Generała George’a Smitha Pattona, 05-077 Warsaw (Barka WIR).
2.2. Each renter is required to familiarize themselves with the content of the Regulations and to strictly adhere to the Regulations, as well as to follow the instructions given by the Company’s employees and employees of cooperating entities.
2.3. The renter must be at least 18 years old on the day of the cruise and must not be under the influence of alcohol or intoxicants.
2.4. The renter renting a boat that requires qualifications must present a valid motorboat license and an ID card or another valid photo ID.
2.5. The renter renting a boat that does not require qualifications must present an ID card and a second photo ID confirming their identity.
3. Rental Rules
3.1. Passengers who have not reached the age of 18 on the day of the cruise can participate in the cruise only with the consent of their legal guardians and under the supervision of an adult.
3.2. The minimum number of participants in a cruise is 2 people.
3.3. The boat rental is based on a signed boat rental agreement and the upfront payment of the rental fee.
3.4. To ensure proper execution of the rental agreement, a deposit is collected. The amount of the deposit depends on the type of boat and the nature of the agreement. The deposit is collected directly at the customer service point, in cash or as a block of funds on a payment card before the reserved cruise date.
4. Reservation Cancellation
4.1. The client can cancel or change the reservation via email at: info@rejsowisko.pl or by phone: +48 576 75 76 79.
4.2. In the case of withdrawal from an agreement concluded electronically, the buyer will receive a full refund of the reservation fee within 30 days from the scheduled cruise date, to the account from which the reservation was paid, or they will have the opportunity to participate in another cruise of equal value to the canceled cruise.
5. Renter’s Responsibility
5.1. The renter cannot sublet the boat and equipment to third parties.
5.2. The renter, upon collecting the equipment, is obliged to check its technical and visual condition, as well as the completeness of the equipment, especially the safety equipment. Paying the deposit will be considered acceptance of the above conditions. This also applies to reservations made electronically.
5.3. The renter is fully legally and financially responsible for the course of the cruise, the behavior of their guests, any material damage, and injuries to all participants of events occurring during the use of the equipment.
5.4. The renter waives all claims against the Company and cooperating entities for accidents caused by improper use of the equipment, failure to follow the instructions of the rental personnel, or failure to follow the instructions given before the cruise in the form of training on the rules of navigating the boat on navigation routes.
6. Prohibitions During the Cruise
6.1. During the cruise, the following prohibitions apply:
• docking to the shore during the entire cruise, unless human health or life is at risk;
• turning off the engine during the cruise with a boat rented without a license;
• pouring substances into the Vistula, throwing garbage or any other objects;
• taking intoxicants or being under the influence of intoxicants during the cruise;
• smoking tobacco;
• jumping from the boat into the water;
• leaning out, extending arms, legs, or objects beyond the boat’s side, which may result in health or life hazards;
• bringing more passengers on board the boat than specified in the agreement;
• bringing flammable, corrosive, or explosive substances on the boat and using open fire;
• using the boat contrary to its intended purpose;
• bringing animals on the boat without the consent of the Rejsowisko Marina staff;
• fishing.
7. Towing Costs and Rental Refusal
7.1. If due to the renter’s fault, towing of the boat to the Marina is required, they will bear the costs associated with initiating the towing procedure, which involves the loss of the deposit up to 300 PLN.
7.2. The renter has the right to refuse to rent a boat to persons:
• whose behavior indicates that they are intoxicated or under the influence of intoxicants;
• who do not follow the instructions of the Rejsowisko Marina staff;
• who grossly or persistently violate the established order or pose a threat to the safety of others;
• who violate the provisions mentioned in section 6.1.
7.3. In the case of a sports boat cruise – those under the influence of alcohol or intoxicants, as well as those who do not follow the instructions of the Rejsowisko Marina staff regarding safety (fastening seat belts, wearing a life jacket, etc.).
8. Passenger Safety
8.1. During the cruise, each passenger will receive a life jacket, which must be worn for the entire duration of the cruise.
8.2. Passengers declare that their health condition allows them to participate in the cruise and undertake to inform the Rejsowisko Marina staff about any illnesses or ailments that may have any significance for their safety during the cruise.
8.3. Unless the cruise includes such a service, the Company is not obliged to provide passengers with food or beverages during the cruise, regardless of the weather.
8.4. The Company is not responsible for delays in cruises caused by poor hydrological conditions, weather conditions, engine or boat equipment failures, or late returns from cruises by customers with previous reservations.
8.5. If the cruise is canceled, the renter will receive a full refund of the reservation fee or have the opportunity to participate in another cruise of equal value to the canceled cruise.
9. Reporting Damage and Property Protection
9.1. Any damage to the boat detected:
• before the cruise must be immediately reported to the Company’s employees or cooperating entities;
• during the cruise must be reported by phone to the number provided on the control panel, i.e., +48 576 75 76 79.
9.2. In situations threatening the life or health of cruise participants and their own, e.g., fire, the unit must be immediately abandoned safely after putting on life jackets and informing the appropriate services (tel. 112) and the marina staff (+48 576 75 76 79).
9.3. The Company and marina staff are not responsible for lost or damaged property of passengers unless these losses result from gross negligence of the Company or marina staff. Passengers should secure their property during the cruise, considering its nature and possible conditions (e.g., falling overboard, impact, falling of mobile phones, cameras, etc.).
9.4. Passengers should secure documents, payment cards, and money against loss or theft. The Company and the Contractor are not responsible for the theft and consequences of theft of documents, payment cards, and other items belonging to the passengers.
10. Passenger Obligations and Rights
10.1. The renter undertakes to cover the costs of repairing equipment damage caused by their fault, as well as the costs of destroyed or damaged equipment or boat fittings.
10.2. Passengers are required to immediately report all comments, reservations, and needs directly to the marina staff. The Company and Rejsowisko Marina staff will make every effort to amicably explain and resolve any disputes.
11. Changes to the Regulations
11.1. The Company reserves the right to make changes to the Regulations, but for cruises already booked on the date of the change, the provisions of the Regulations in the version applicable at the time of booking will apply.
11.2. The Regulations come into force on April 1, 2022.
